SUPPLEMENTARY REPORT

From Saturday 26.9.15: Stewards today concluded their inquiry into jockey Gary Geran’s riding of LEGSMAN in Race 5 at the Toowoomba Turf Club meeting on 15 August 2015. The inquiry was opened following a complaint lodged by Ms L. Paton, the trainer of LEGSMAN, in that jockey Geran failed to ride LEGSMAN as per her pre-race instructions, which were to lead or at least obtain a forward position. After taking evidence on the night in question the inquiry was adjourned to allow Stewards to review the betting information on the race and to further consider the evidence tendered at the inquiry.

After considering the evidence, Stewards found that in the early stages of the event STORM MAGIC showed superior speed to LEGSMAN and therefore it was not unreasonable for jockey Geran to allow that runner to cross to the lead shortly after passing the winning post on the first occasion. Stewards did however feel that jockey Geran erred in his riding in the section between the 1600m and the 1400m whereby he overly restrained LEGSMAN which allowed DOUBLE EAGLE to cross LEGSMAN, resulting in the gelding racing further back in the field. Stewards further found that approaching the 1300m LEGSMAN received minor tightening from another runner which resulted in it losing further ground at that point of the race.

Whilst Stewards were critical of jockey Geran’s riding between the 1600m and the 1400m, they did not feel that this error was significant enough to constitute a breach of the rules, nor did they feel that it affected the overall finishing position of LEGSMAN, bearing in mind the manner in which it finished the race off over the concluding stages. Therefore, Stewards took the matter no further other than to advise jockey Geran that where possible every endeavour should be made to ride his mounts as per the pre-race instructions.

A synopsis of the betting revealed no abnormal betting trends.

GENERAL

As J. Hoopert was injured, riding replacements were made as per the Stewards Race Day Summary.

Race 1: HAPPY BIRTHDAY JENNY GRACE CLASS 2 H'CAP – 1310M

MASSIVE ATTACK – Raced keenly in the middle stages.

ON MY ROCKET – Steadied from heels approaching the 700m.

MINE WITH LIME – Slow to begin. Steadied from heels approaching the 700m.

HEY MURRI – Blundered on jumping away.

SNEAKY PETERSON – Failed to muster early speed and as a result settled further back in the field than anticipated. Stewards questioned apprentice R. Payne in relation to her riding of the horse during the event. Apprentice Payne advised that the horse did not begin well and as a result raced at the tail of the field. She added that throughout the event the horse resented racing through the kickback and as a result failed to run on as she expected in the home straight and proved disappointing. When asked to explain the reasoning for the horse racing some three lengths behind the second-last horse during the early and middle stages, apprentice Payne, after having the opportunity to review the films, believed she had erred in her riding in that she did not pressure the horse more to obtain a position closer to the main body of the field. Whilst Stewards agreed that apprentice Payne had erred in her riding in the early stages, they did not feel that her riding fell below the required standard and, bearing in mind the manner in which the horse finished the race off over the concluding stages, did not take the matter any further.

RITZY BELLE – Momentarily held up rounding the home turn.

Race 2: MITTY’S CLASS 4 H'CAP – 1310M

LORD BEAUFORT – Slow to begin. Forced to steady near the 200m to avoid the heels of ROCKDAY, which shifted in under hard riding. G. Geran, the rider of ROCKDAY, was reprimanded.

HUXTABLE – Finished tailed off. A post-race veterinary examination revealed no abnormalities. In light of the performance tonight, trainer R. Stephenson was advised that the gelding will be required to trial to the satisfaction of Stewards prior to next racing.

WOW FACTOR – Apprentice L. Attard was reminded of his obligations in relation to raising his whip arm above shoulder height.

HOT TESTA – Slow to begin.

HIP TO BE SQUARE – Raced wide throughout.

Race 3: TYRRELL’S WINES CLASS 3 H'CAP – 1000M

NITSA – Fractious in the barriers, dislodged rider and became cast. Declared a late scratching at 6.56 pm. Stewards ordered that all monies invested on NITSA be refunded, with the following deductions to apply to bets placed prior to 6.56 pm.

Trainer M. Nolan was advised that NITSA must perform satisfactorily in two official consecutive barrier trials prior to being permitted to race again.

POCILLO – Blundered on jumping away.

THAT’S JERRY – Raced wide throughout.

DON’TCRYARGENTINA – Slow into stride. Stewards questioned trainer P. Kalinowski in relation to the horse’s seemingly improved performance. Ms Kalinowski stated that as the horse had only been in her stable for 6 days leading into tonight’s event, she could offer no tangible explanation for the improved performance.

Race 4: NEIL MANSELL TRANSPORT MAIDEN PLATE – 1310M

MORE VALUE – Began awkwardly. Commenced to overrace badly for a considerable distance after being crossed by another runner near the 1100m.

RUNAWAY RULER – Steadied to avoid the heels of another runner near the 1100m. Laid in under pressure in the home straight.

RAPPELL – Raced ungenerously in the early stages. Raced wide throughout.

ANYOAKEE – Cast the off hind plate in running.

Race 5: MELBOURNE CUP, NOVEMBER 3RD, 2015 MAIDEN PLATE – 1310M

DAZZLING SHIRAZ – On returning to scale G. Geran reported that after beginning well he obtained a more forward position than anticipated.

ENEMY’S DEFEATED – Trainer J. Marlow was reprimanded for the late declaration of J. Orman as the rider of this horse. In determining penalty, Stewards took into account Mr Marlow’s previous good record in relation to this matter. Slow to begin. Apprentice J. Orman was reprimanded for using the whip in a forehand manner more than 5 times prior to the 100m.

HELLO HARRA – Raced wide in the early stages.

NOW LISTEN – Raced wide throughout. On returning to scale apprentice R. Payne advised that in her opinion NOW LISTEN, which was first up from a spell today, would derive a significant fitness benefit from tonight’s performance and would also benefit from stepping up to a more suitable distance at future runs in its preparation.

BONSEA – On returning to scale apprentice T. Brooker reported that her mount raced keenly after being ridden forward to obtain the leading position.

HOW SWEET – Momentarily steadied from heels passing the 800m.

PRECIOUS EMBERS – Slow to begin.

STAR OF AQUARIUS – After initially laying in and away from DAZZLING SHIRAZ near the 1100m, was then forced to steady to avoid the heels of that runner after being crossed. Improved on to the heels of another runner near the 900m and was steadied. Stewards questioned S. Bogenhuber in relation to the performance of the horse, which was a drifting favourite in tonight’s event. Jockey Bogenhuber advised that she obtained a good position throughout the event, however when trailing the eventual winner passing the 600m she was unable to quicken with that runner and ran on only fairly over the concluding stages. Trainer M. Nolan advised that the mare had worked well in preparation for today’s event and he had expected a forward showing, however, based on the horse’s finishing effort tonight, he may now step the horse up in distance for its future starts. Stewards noted the explanations.

Race 6: AUDI CENTRE TOOWOOMBA QTIS 3YO MAIDEN PLATE – 1210M

After viewing the Stewards’ patrol footage, apprentice S. Payne, the rider of FRENCH SONG, placed 2nd by the Judge, lodged an objection against TYCOON ACE being declared the winner, alleging interference near the 1000m. After taking evidence from all parties and viewing the videos, it was established that prior to being crossed by TYCOON ACE, FRENCH SONG had already commenced to race ungenerously with its head in the air and any interference caused to that runner was not attributable to TYCOON ACE. Therefore, Stewards dismissed the protest and declared correct weight on the Judge’s placings.

AGENT ALBERT – Bumped heavily with another runner at the start.

CALCETINES – Slow to begin.

TYCOON ACE – Bumped heavily with another runner at the start.

ARUWIN – Trainer N. Hilton was fined $100 for the late declaration of T. Brooker as the rider of this horse. Slow to begin. Trailed the field throughout and proved uncompetitive. A post-race veterinary examination revealed no abnormalities. Trainer N. Hilton was advised that in light of the performance, the horse’s nomination would be restricted to non-TAB venues until such time as it establishes country form.

FRENCH SONG – Bumped heavily with another runner at the start. Hung out on the home turn.

GOOD AFFAIRE – Bumped heavily with another runner at the start.

Race 7: WELLCAMP AIRPORT CLASS 1 PLATE – 1650M

CASINO GOLD – Near the 900m and again at the 800m had to be steadied to avoid the heels of another runner which laid in despite the efforts of its rider. Momentarily steadied to avoid the heels of another runner approaching the 400m.
